Welcome to The Pickleball People.

These Terms of Service (“Terms”) govern your access to and use of our website, products, services, content, and related features (collectively, the “Services”).

By accessing our website or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree with these Terms, please do not use the Services.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order.

By using the Services, you represent that you have the legal capacity to enter into a binding agreement.

Products and Print-on-Demand Production

Products sold by The Pickleball People are produced through third-party print-on-demand and fulfillment partners.

We make reasonable efforts to accurately display product designs, colors, sizes, descriptions, and other details. Actual appearance may vary slightly because of screen settings, printing processes, materials, and normal manufacturing tolerances.

Minor variations in print placement, color, sizing, or other production details are normal and do not necessarily constitute a defect.

We may modify or discontinue products, update pricing, or correct errors or omissions at any time.

Orders

Placing an order constitutes an offer to purchase the products in your order.

We may decline, limit, or cancel an order when reasonably necessary, including because of:

• Product unavailability

• Pricing or listing errors

• Suspected fraud or unauthorized payment activity

• Problems processing payment

• Violation of these Terms

If we cancel an order after payment has been collected, the applicable amount will be refunded.

Order Cancellations

Because our products are produced on demand, production may begin shortly after an order is placed.

Orders may be cancelled or changed only before production begins. Once production has started, we may be unable to cancel or modify the order.

Pricing and Payment

All prices are displayed in U.S. dollars unless otherwise stated.

Applicable taxes and shipping charges, if any, will be shown at checkout.

You agree to provide accurate billing and payment information and authorize us and our payment providers to process charges associated with your order.

Shipping

We currently ship within the United States only.

Processing, production, shipping, and delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control, including carrier delays, severe weather, labor disruptions, or other unexpected events.

Tracking information will be provided when available.

If an order is lost, arrives damaged, or has another delivery problem, please contact us so we can investigate and work toward an appropriate resolution.

Returns, Refunds, and Product Issues

Returns, refunds, and replacements are governed by our Refund Policy.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

Intellectual Property

The content available through The Pickleball People, including our logos, artwork, original designs, graphics, product images, product names, text, branding, and website content, is owned by The Pickleball People or used with permission from its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, sell, license, commercially exploit, or create derivative works from our protected content without prior written permission, except as permitted by law.

Customer and Social Media Content

If you voluntarily submit photographs, reviews, testimonials, or other content to us for publication, or expressly give us permission to share such content, you grant The Pickleball People a non-exclusive, worldwide, royalty-free license to reproduce, display, and share that content for our website, social media, and marketing purposes.

You retain ownership of your content.

If you would like us to stop using content you previously authorized us to use, please contact us. We will consider reasonable removal requests in good faith.

Prohibited Uses

You may not use the Services to:

• Violate applicable laws or regulations

• Infringe intellectual property or other rights

• Engage in fraudulent or deceptive activity

• Upload or transmit malicious software

• Attempt unauthorized access to our systems

• Disrupt or interfere with website operations

• Impersonate another person or entity

• Use automated systems to access or scrape the Services in a manner that places an unreasonable burden on our systems

We may restrict or terminate access to the Services for violations of these Terms.

Third-Party Services

Our Services rely on third-party providers, which may include Shopify, print-on-demand and fulfillment providers, payment processors, shipping carriers, analytics providers, and marketing platforms.

We are not responsible for third-party websites or services that are outside our control.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be uninterrupted, error-free, or completely secure.

Any warranties or rights that cannot legally be excluded or limited remain unaffected.

Limitation of Liability

To the fullest extent permitted by applicable law, The Pickleball People will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services.

To the fullest extent permitted by law, our aggregate liability arising from a product, order, or use of the Services will not exceed the amount you paid for the product or order giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Pickleball People and its owners, affiliates, contractors, service providers, and representatives from third-party claims arising from your unlawful misuse of the Services, infringement of another party’s rights, or material violation of these Terms.

Governing Law and Venue

These Terms and your use of the Services are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Except where applicable law provides otherwise, disputes arising from these Terms or the Services that cannot be resolved informally will be brought in the appropriate state or federal courts located in King County, Washington.

Nothing in these Terms limits any non-waivable rights or remedies available to consumers under applicable law.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, or legal requirements.

The revised Terms will be posted on this page with an updated “Last Updated” date. Changes apply to use of the Services after the revised Terms become effective.
